HON'BLE Smt JUSTICE ANIS CRIMINAL PETITION No.2677 of 2015 ORDER:

This Criminal Petition is filed by the petitioner, under Section 482 Cr.P.C, seeking a direction to dispose of the complaint, vide CC(SR).No.4320 of 2013 on the file of II Additional Judicial Magistrate of First Class, Tanuku, for the offence punishable under Section 193 IPC.

Learned counsel for the petitioner submits that the petitioner is aged 77 years and, though his sworn statement was recorded, no orders were passed by the learned Magistrate to take cognizance and number the case and, therefore, he seeks a direction to the learned Magistrate to dispose of the complaint as early as possible.

Heard the learned Public Prosecutor appearing for the State. Considering the fact that the petitioner is aged 77 years, and his sworn statement was already recorded, the learned Magistrate shall take cognizance of the offence, dispose of the complaint by recording evidence and after affording an opportunity of hearing to both sides, as early as possible, preferably, within a period of six months from the date of receipt of a copy of this order.

The Criminal Petition is, accordingly, disposed of. Miscellaneous petitions pending, if any, shall also stand disposed of. ANIS,J Date:02.04.2015 usd
