HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28602 of 2017 ORDER:

The grievance of the petitioners in this writ petition is that the Southern Power Distribution Company of Telangana Limited (TSSPDCL) is not releasing the power supply to their building on the ground of not producing occupancy certificate.

Heard the learned Counsel for the petitioners and the learned Standing Counsel for TSSPDCL and perused the material on record and also the orders passed in similar matters by this Court. It is brought to the notice of this Court that this Court by order dated 13.02.2017 in W.P.M.P.No.3057 of 2017 in W.P.No.2608 of 2017 directed the respondents therein to release the power supply to the building of the petitioner therein subject to the compliance of the terms and conditions of supply of the respondents and the same can be withdrawn if an occupancy certificate was not obtained later from the municipal authorities.

In view of the above, this Writ Petition is also disposed of with a direction to the respondents to release the power supply to the premises of the petitioners subject to the compliance of the terms and conditions of supply and on furnishing an undertaking to produce the occupancy certificate from the concerned Municipality/Municipal Corporation within three months, and if no such occupancy certificate is produced within such period, it is open to the respondents to take appropriate action in accordance with law.

The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ___________________________ A.RAMALINGESWARA RAO, J 24.08.2017 pln
