Kommineni Venkateswarlu, v. Prl.Secy., Civil Supplies Dept., State Of A.P.,
HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT APPEAL No. 610 of 2018 JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) This writ appeal is against the judgment of the learned Single Judge. 2) We have heard the learned counsel for the appellant and the learned Government Pleader for the respondents.
3) The appellant applied for being considered for appointment as fair price shop dealer.
4) The fact of the matter remains that the appellant did not make an application within the time fixed as per the notification. That apart, though he claimed that his father had been a fair price shop licensee, and who died while acting so, the appellant was beyond the age of 40 years, which is a maximum limit for a person to be appointed as fair price shop dealer. In such circumstances, we do not find that the learned Single Judge committed any jurisdictional error or any illegality in the matter.
5) The writ appeal therefore fails and is accordingly dismissed. 6) Miscellaneous petitions, if any, shall also stand dismissed. ______________________________________ THOTTATHIL B. RADHAKRISHNAN, CJ ___________________ P. KESHAVA RAO, J Date: 23.08.2018 ES/CCM
