HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5367 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/A1 and A2 under Section 482 Cr.P.C seeking to quash the proceedings in crime No.217 of 2015 of Hayathnagar Police Station, Cyberabad, Ranga Reddy District, for the offences punishable under Sections 420, 468, 471, and 506 I.P.C.

Heard the learned counsel for the petitioners and the learned Public Prosecutor appearing for the State, before notice to respondent No.2/de facto complainant and before admission.

Perused the material on record. The material on record falls short for this Court to admit the application under Section 482 Cr.P.C. As the facts disclose that some of the accused are already enlarged on bail, this petition is disposed of giving liberty to the petitioners to surrender before the learned Magistrate concerned and move for regular bail with notice to Additional Public Prosecutor. In such an event the learned Magistrate shall grant bail with necessary conditions, preferably on the same day.

Needless to say pending investigation the learned Magistrate can dispense with the presence of accused. Any other remedy is left open to the petitioners, in the event of police filing final report.

Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
