This writ petition is filed under Article 226 of the Constitution of India, for the following relief:
"To issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the Proceedings Memo No. 613/A/2016, dated 30-06-2016 issued by the 2nd Respondent, as illegal, arbitrary, and violative of Articles 14 and 16 of the Constitution of India, and consequently direct the Respondent Nos. 2 and 3 to provide membership to the Petitioners in the Fishermen Cooperative Society, Anantharam village, Konijerla Mandal, Khammam district, in the interest of justice." 2.
When the matter is called, it is represented by the learned counsel for the petitioners as also the learned Government Pleader that the issue in the present writ petition is squarely covered by the Judgment of this Court in W.P.No.34793 of 2013 dated 20.11.2015 and the copy of the same is placed on record along with writ petition as material paper. 3.
In view of the above judgment and for the reasons recorded therein, this writ petition is allowed, setting aside the Memo.No.613/A/2016 dated 30.06.2016 and the second respondent is directed to consider the applications of the petitioners for admission in to the third respondent/society strictly in accordance with G.O.Ms.No.74, Animal Husbandry, Dairy Development and Fisheries (F.II) Department, dated 21.10.2011, without reference to the castes to which the petitioners belong. This exercise shall be completed within eight weeks from the date of receipt of this order. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
