HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23670 OF 2010 ORDER:

This writ petition is filed challenging the award passed by the Tribunal in I.D.No.240 of 2006, dated 23.3.2010, whereunder the Tribunal modified the order of removal to that of compulsory retirement, and seeking a direction to the respondents to reinstate the petitioner into service and to pay the wages for the removal period along with all benefits.

When this matter is taken up for hearing, it is informed by the learned Counsel for the petitioner that the petitioner attained the age of superannuation, and in view of the same, the question of reinstatement does not arise. 3.

Recording the above submission, the Writ Petition is dismissed. However, it is made clear that the compulsory retirement benefits, if not already paid, shall be paid to the petitioner within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
