2) Therefore, this petition is dismissed as withdrawn with a liberty to take recourse by filing an application under Section 227 Cr.P.C for discharge before the trial Court if there are no grounds for framing of charge and the same shall be decided on own merits basing on the prosecution material vide State of Orissa V.
