HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER C.M.P. No.238 OF 2018 ORDER:

The present Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, 1908, by the petitioner - wife viz., Smt. Boddu Veena, requesting to withdraw F.C.O.P. No.24 of 2018 pending on the file of Family Court, Warangal, and to transfer the same to the file of Family Court, Ranga Reddy District.

2. The husband of the petitioner filed the above F.C.O.P. against her for dissolution of marriage and for grant of decree of divorce.

3. Heard Sri T.V. Laxmi Kantham, learned counsel for the petitioner, and perused the material on record.

4. The learned counsel for the petitioner filed postal track consignment showing service of notice on the respondent. Thus, despite service of notice, respondent has not chosen to make his appearance.

5. In the present transfer application, learned counsel for the petitioner would submit that since the petitioner did not meet the demand of her husband for bringing additional dowry and also on the ground that she did not beget any children, subjected her to unabated

No.238 OF 2018 harassment and also attributed that she was suffering from unsound mind and there was no chance of her procreating children, driven her out of the house and, that she is struggling to study B.Ed. Course (Teacher Training) and she has no finances to visit the Court at Warangal as she belongs to Ranga Reddy District and even she has no male assistance to accompany her which facts have been vividly narrated in the affidavit filed by the petitioner sought to allow the petition.

When, kept in view, that male assistance is required to accompany the petitioner and even some amounts she has to incur to travel to Warangal to attend the Court, it would be reasonable to accede to her request as it would not cause any inconvenience to the respondent to attend the Court at Hyderabad, by travelling from Warangal.

7. Therefore, the present Transfer Civil Miscellaneous Petition is allowed at the admission stage itself. Consequently, F.C.O.P. No.24 of 2018 pending on the file of the Family Court at Warangal, is withdrawn and transferred to the Family Court at Ranga Reddy District. On receipt of case bundle, the Family Court, Ranga Reddy District, is directed to issue notices to the parties and dispose of the matter in accordance with law. There shall be no order as to costs.
