HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY APPEAL SUIT Nos. 1417 OF 1997 AND 1346 OF 1999 COMMON JUDGMENT:

When both these Appeals were listed on 25.08.2015, there was no representation for the appellants and, hence, both the matters were directed to be listed under the caption 'for dismissal' on 07.09.2015. Accordingly, when the matters appeared in the cause list, on 07.09.2015, though the learned counsel for the appellants, in both the Appeals, is present, no substantial argument was advanced by him and, at his request, both these matters were again directed to be listed under the caption 'for dismissal' to this date. Even today, when the matters appeared in the list, Sri M. Rama Rao, learned counsel for the appellants, conveniently avoided to appear and entrusted the matters to Sri E. Partha Sarathy, learned counsel, to seek adjournment.

However, this Court is not inclined to grant adjournment since the matters have already listed under the caption 'for dismissal' twice. Therefore, both the Appeals are dismissed for default.
