HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29604 OF 2011 O R D E R :

This petition is filed for a writ of Mandamus seeking direction to the respondents to complete the process of building application No.0392 dated 23.09.2011, within a time bound programme declaring their inaction as illegal and arbitrary.

When the matter is listed today, learned counsel for the petitioner submits that the State Government has issued a notification for regularising the illegal constructions and the petitioner wants to avail the above said benefit. On the other hand Smt.K.Mani Deepika, learned Standing Counsel for the 2nd respondent, on instructions, submits that as some defects were noticed, the application dated 23.09.2011, submitted by the petitioner for grant of permission for construction has been rejected. In the present case, since the learned counsel for the petitioner is not pressing for any relief in the writ petition and since it is stated that the application of the petitioner for building permission was rejected, no relief is being granted except giving liberty to the petitioner to avail the other remedies available to him for regularisation of the building, if any such scheme is available.

Accordingly, the writ petition is dismissed. No costs. As a sequel thereto, miscellaneous applications, if any, pending in the contempt case, shall stand closed.
