HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION Nos.7855 & 7864 of 2015 COMMON ORDER :

The Criminal Petition No.7855 of 2015 is filed by petitioner/A-1 seeking to quash the proceedings in C.C. No.269 of 2013 on the file of II Additional Chief Metropolitan Magistrate, Vijayawada and the Criminal Petition No.7864 of 2015 is filed by the petitioner/A-2 seeking to quash the proceedings in Crime No.303 of 2010. Both the proceedings stated supra registered at the instance of the 2nd

respondent for the offence punishable under Section 420 I.P.C against five accused including the petitioners as can be seen, and A2 of crime No.303 of 2010 of Machavaram Police Station of Krishna District.

2) The respective accused as well as the same defactocomplainant/2nd respondent in both the petitions present before this Court and filed petitions with affidavit of the G.P.A holder of the defacto-complainant seeking permission to recognize the G.P.A and with petitions seeking permission to compound the offence stating with joint memo and affidavit of the amicably settled outside the Court and to purchase peace including any monetary claims and hence to compound.

3) Heard the learned counsel for the petitioners and perused and permission is accorded by ordering the respective petitions today to represent through G.P.A holder and for compounding the offence.

4) Accordingly both the criminal petitions are allowed and all the proceedings in C.C. No.269 of 2013 on the file of II Additional Chief Metropolitan Magistrate, Vijayawada and Crime No.303 of 2010 of Machavaram Police Station, Vijayawada, Krishna District are quashed. The bail bonds of the accused, if any, shall stand cancelled. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
