HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.4381 of 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/A1, seeking to grant anticipatory bail to him in Crime No.86 of 2019 on the file of WPS City Police Station, Warangal District, registered for the offences under Sections 498-A, 506 and 307 IPC. 2.
Heard learned counsel for the petitioner/A1, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the complaint that the daughter of the de-facto complainant and A1 fell in love with each other and got married on 28.08.2009 and after marriage, they led happy marital life for a period of four years and blessed with two female children. Thereafter, A1 and other accused used to harass her physically and mentally by demanding additional dowry of Rs.15,00,000/- and threaten her with dire consequences to kill her. The petitioner/A1 also attempted to kill her by pressing throat with hands and belt. 4.
Learned counsel for the petitioner/A1 submits that the petitioner is innocent and he never involved in any crime much less the present one and he was falsely implicated in the aforesaid case. He further submits that as their marriage was inter-caste, the family members of the de-facto complainant did not allow them to their house for a long time and after birth of two children, the de-facto
complainant and his wife used to visit their house and developed differences between them. He further submits that the petitioner is a Government employee working in Indian Railways and he has to look after his aged mother and children. He further submits that the petitioner is ready and willing to abide by any condition imposed by this Court.

In view of the serious nature of allegations leveled against the petitioner that he attempted to kill his wife, this Court is not inclined to grant anticipatory bail to him.

Hence, the Criminal Petition is dismissed. However, the petitioner/A1 is directed to surrender before the trial Court within 10 days from the date of this order and move an application for bail. On filing such application, the trial Court may consider the same in accordance with law.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
