THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.8970 of 2016 ORDER:

This petition is filed under Section 483 Cr.P.C. challenging the inaction on the part of the III Additional Metropolitan Magistrate, Cyberabad at L.B.Nagar, Ranga Reddy District, in not disposing of Crl.M.P.No.1669 of 2012 in D.V.C.No.11 of 2008.

2. Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State.

3. A perusal of the record reveals that the trial Court issued a Non-Bailable Warrant (N.B.W.) against the second respondent in D.V.C.No.11 of 2008 on 27.06.2012. The second respondent filed Crl.M.P.No.1669 of 2012 in D.V.C.No.11 of 2008 under Section 70(2) Cr.P.C. to recall the N.B.W. issued against him.

4. Learned counsel for the petitioner submitted that the petition is pending since 2012.

5. Taking into consideration the facts and circumstances of the case, th e III Additional Metropolitan Magistrate, Cyberabad at L.B.Nagar, Ranga Reddy District, is hereby directed to dispose of Crl.M.P.No.1669 of 2012 in D.V.C.No.11 of 2008 in accordance with law within one (1) month from the date of receipt of a copy of this order.

6. With the above direction, the Criminal Petition is disposed of. 7.

Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
