THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.4521 OF 2018 ORDER:

Sri Sarvabhouma Rao, learned counsel for the petitioner seeks permission of this Court to withdraw the criminal petition and requested this Court to dispense with the personal appearance of the petitioner in C.C. No.464 of 2017 pending on the file of Additional Judicial First Class Magistrate, Bapatla. Permission is accorded.

Accordingly, the criminal petition is dismissed as withdrawn. However, it is for the trial court to decide whether the presence of the petitioner is required on every date of adjournment in C.C. No.464 of 2017, and therefore, it is a fit case to direct the petitioner to file an appropriate application under Section 205 Cr.P.C. or under Rule 37 of the Criminal Rules of Practice before the trial court and on filing such application, the trial court is directed to dispose the same within a week from the date of filing such application, in accordance with law.
