HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7472 of 2017 ORDER:

Heard learned counsel for the petitioner/ accused of Crime No.142 of 2017 on the file of Ameenpur Police Station, Sanga Reddy District, registered for the offences punishable under Sections 406 and 420 I.P.C., which is outcome of the report of the 2nd respondent/ de facto complainant alleging that the land in question formed into plots and one of the plots sold under agreement for a valuable consideration is by suppression of the factum of the land belongs to the Government and not private land of the petitioner.

Whereas, it is the contention of the learned counsel for the petitioner that it is a private land even as per the revenue permanent records by drawing attention to some entries and the learned Public Prosecutor submits that the police investigation also discloses it is a Government land.

Having regard to the above, there is nothing to quash the F.I.R. much less to interdict the investigation, but for, to say in the factual scenario not to arrest the petitioner pending investigation. However, this will not prevent the Police to secure his presence for investigation as and when required.
