HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.6270 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies-respondents. 2 . This writ petition is filed seeking writ of Mandamus declaring the proceedings of the 3rd respondent dated 07.02.2015 cancelling the authorisation of the petitioner for supply of essential commodities in Macherla Village, without following the procedure contemplated under the provisions of Licensing Orders, as illegal and arbitrary.
3. The petitioner is the Fair Price Shop dealer of Macherla Village. On the allegation of certain irregularities committed by the petitioner, the 3rd respondent issued show cause notice dated 18.12.2014 to the petitioner, for which he submitted his explanation on 31.12.2014. It is submitted by the learned counsel appearing for the petitioner that the 3rd respondent passed an order of cancellation against the petitioner without enquiry and not even affording opportunity of personal hearing to the petitioner. In any event, the petitioner preferred an appeal before the Collector, Mahaboobnagar District, which is now pending. According to the petitioner, he filed appeal on 20.02.2015 and along with the said appeal, he filed an application seeking stay of cancellation order. It is submitted that no orders so far have been passed on the said application.
4. Under these circumstances, the 2nd respondent-District Collector (CS), Mahaboobnagar District, is directed to dispose of the appeal as well as the stay petition filed by the petitioner, within a period eight (8) weeks from the date of receipt of a copy of this order.
5. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
