THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.3305 of 2016 ORDER:
The prayer of the petitioners in this case is as under: "The Hon'ble Court may be pleased to issue writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the seizure of vehicles bearing Nos. AP 28 TC 8080, AP 28 TC 8076 & AP 28 TC 8079 belonging to the Petitioner No.1 and JCB bearing No. KA 01 AB 1157 and not releasing the same as arbitrary, illegal, unjust and in violation of Mines and Minerals (Development & Regulation) Act 1957 and A.P. Minor Mineral Concession Rules 1966 and pass such other order or orders as the Hon'ble Court deems fit and proper in the interest of justice."
Written instructions dated 10.02.2016 were furnished by the Station House Officer, Banaganapalli Police Station, Kurnool District, to the office of the learned Government Pleader for Home, wherein he stated that the seized vehicles bearing registration Nos. AP 28 TC 8080, AP 28 TC 8076 & AP 28 JC 8079 were deposited before the learned Judicial First Class Magistrate, Banaganapalli. Smt. P. Vijaya Lakshmi, learned counsel for the petitioners, states that the petitioners have already approached the Court below by filing an appropriate application under the Code of Criminal Procedure, 1973, seeking release of the vehicles. That being so, this writ petition need not be entertained for adjudication on merits. The writ petition is accordingly closed leaving it open to the petitioners to pursue their remedies in accordance with law. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
