This writ petition is filed challenging the order of the 2nd respondent vide proceedings No.487/10-B1/(Pan), dated 09.07.2010 whereby and where under the petitioner was suspended from the post of Sarpanch of Gram Panchayat, Kodada, which was confirmed by the 1st respondent vide proceedings G.O.Rt.No.252, PR & RD (PTS.11) Department, dated 21.02.2011.
Learned Assistant Government Pleader for Panchayat Raj submits that the petitioner was elected as Sarpanch of Grama Panchayati, Kodada in the election to the office of Sarpanch for the elections conducted in the year 2006 and took oath on 27.08.2007, as such, term of the office is over and writ petition becomes infructuous.
Learned counsel for petitioner submits that under Section 249(3) of A.P.Panchayat Raj Act, 1994, if a Sarpanch is removed from office, he/she shall not be eligible for re-election for a period of two years and that by efflux of time, the said disqualification will not attract. He further submits that the Kodada Gram Panchayat had been upgraded as Municipality. Even according to the affidavit filed by the petitioner in support of the writ petition, she took oath on 27.08.2007, as such, writ petition becomes infructuous.
In view of above facts and circumstances, the cause in the writ petition does not survive for consideration.
Accordingly, this writ petition is dismissed. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand dismissed. _________________________ A.RAJASHEKER REDDY,J 13-06-2017 kvs
