THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25760 of 2009 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

This writ petition is filed declaring the action of respondents 2 and 3 in harassing the petitioner by calling him to the police station and insisting him to sell his Plot No.10 in Sy.No.6 to an extent of 240 sq. yards situated at Dinnadevarapadu Village, Kurnool District. Learned Government Pleader produced instructions, which read as follows:- "It is submitted that pursuant to the private complaint lodged by the petitioner before the Hon'ble Judicial First Class Magistrate, Kurnool and as referred to the Station House Officer, Kurnool II Town Police Station a case in Cr.No.269 of 2010 under Sections 405, 417, 420 IPC r/w Section 156(3) Cr.P.C. has been registered on 24.07.2010 against K.Annapurna @ Anuradha W/o K.Anjaneyulu on the file of Kurnool II Town Police Station, and took up the investigation.

The sum and substance of private complaint is that, K.Annapurna @ Anuradha/accused had borrowed a sum of Rs.40,000/- from the complainant by entering into agreement of simple mortgage by keeping an unalienable property as a security and deceived and cheated the complainant.

During the course of investigation the petitioner has been examined as Lws 1 and his detailed statement had been recorded.

After completion of Investigation and after obtaining permission from the Sub Divisional Police Officer, Kurnool vide C.No.393/SDPOK/2010 dated 20.09.2010 and after serving notice to the complainant, final report has been filed as "CIVIL NATURE" on 22.10.2010 before the concerned court. It is submitted that, except referring the above crime, as civil in nature, this respondent did not call the petitioner to the police station and did not harass and interfere with the property of the petitioner at any point of time."

In view of the same, no further orders are necessary in this writ petition.

Accordingly, the Writ Petition is closed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
