THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3534 of 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to issue writ of Mandamus to declare the action of the respondents in threatening to disconnect power supply to the petitioner's Electrical Service Connection No.2822 of Kaikaram Village in Gollagudem Section and insisting the petitioner to pay balance of Provisional Assessment Amount connected to Service Connection No.2590 of same Village belonged to his wife Rudraraju Malleswari, pursuant to Provisional Assessment Notice dt.05.07.2016 in Lr.ADE/O/R/TPG/F.No./D.No.

581/16 issued by 5th respondent, as illegal, irregular, irrational, without any authority of law, violative of principles of natural justice, provisions of The Electricity Act, 2003, rules and regulations framed there under and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents not to disconnect power supply to the petitioner's said service connection, nor insist him to pay any provisional assessment amount connected to his wife's service connection." When the matter is taken up, it is represented by Sri M.

Ravindra, learned Standing Counsel for the respondents that this writ petition is filed only on the ground of mere apprehension and the respondents will follow due process of law only and after issuing notices action would be taken, as per law.

The said submission is recorded.

In view of the above, the writ petition is disposed of, directing the respondents herein to proceed, if they are advised to do so, in accordance with law, after giving notice and opportunity to the petitioner hearing.

Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
