HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 4147 of 2007 O R D E R:- When the matter is taken up for hearing, it is noticed that the writ petition against the 2nd respondent was dismissed for default by order dated 24.06.2011 passed by this Court, and thereafter, no steps have been taken by the petitioner to see that the writ petition is restored against the 2nd respondent.

In this writ petition, the petitioner - Corporation is challenging the Award dated 28.07.2006 in I.D.No. 421 of 2002 passed by the Industrial Tribunal-cum-Labour Court, Ananthapur and the award is in favour of the 2nd respondent. Inasmuch as the award passed by the Labour Court is in favour of the 2nd respondent, but the writ petition against her has been dismissed for default way back in the year 2011 and the same has not yet been restored to its file, this Court, without hearing the 2nd respondent, cannot adjudicate the matter on merits.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
