THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE MS. JUSTICE J.UMA DEVI WRIT PETITION No. 29815 of 2017 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri Vedula Venkataramana, learned Senior Counsel appearing on behalf of the petitioner, would submit that, by oversight, the petitioner had failed to challenge the vires of the first proviso to Section 434 (1) of the Companies Act, 2013 which provides that only such proceedings, relating to the winding up of the companies, shall be transferred to the Tribunal that are at a stage as may be prescribed by the Central Government. Learned Senior Counsel seeks permission to withdraw the writ petition with liberty to challenge the vires of the aforesaid proviso, in addition to the challenge to the Rules made in terms thereof. Granting liberty as sought for, the writ petition is dismissed as withdrawn. Miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
