THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.13815 of 2015 ORDER:

This writ petition is filed challenging the action of the 4th respondent in not receiving the demand draft for release of the essential commodities to the petitioner's fair price shop on the ground that the appeal before the Joint Collector was not disposed of within the time prescribed by this Court in W.P.No.2679 of 2015 dated 10.02.2015.

Now the learned Government Pleader, on the basis of the written instructions, submits that the appeal was disposed of in June, 2015, and the matter was remanded to the Revenue Divisional Officer, Anantapur, to reexamine the case giving opportunity to the dealer and pass appropriate orders afresh in the mater following due procedure. In the circumstances, the writ petition has become infructuous, and it is, accordingly, dismissed as infructuous. However, the 3rd respondent to whom the case is remanded is directed to complete the enquiry and pass appropriate orders within a period of sixty (60) days from the date of receipt of a copy of this order, as per the order of the remand of the 2nd respondent. There shall be no order as to costs. As a sequel, the miscellaneous petitions, if any pending in this writ petition, shall stand closed.
