THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR CRI MI NAL PETI TI ON No.14484 OF 2016 ORDER:

The petitioner, who is A.1, preferred the present Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973, seeking relaxation of the conditions imposed on the petitioner in the Order dated 14.09.2016 passed in Crl.M.P.No.574 of 2016 by the Judge, Family Court-cum-VIII Additional District and Sessions Judge, Prakasam at Ongole, in connection with Crime No.46 of 2016 of Women Police Station, Ongole, registered for the offences punishable under Sections 448, 427, 323, 495, 498-A, 420 and 506 IPC. 2.

By an Order dated 14.09.2016, the Court below granted anticipatory bail to the petitioner with the following conditions: "i) A.1 alone is directed to appear before the said Station House Officer thrice in a week i.e., on every Monday, Wednesday and Saturday, between 10.00 a.m., and 5.00 p.m., till filing of the charge sheet.

ii) The petitioners/Accused A1 and A2 shall cooperate with the investigating agency as when required for the purpose of investigation.

iii) The petitioners/A1 and A2 shall not tamper or interfere in any manner with the witnesses or with the investigation of the police.

iv) The petitioners/A1 and A2 shall furnish their full address and further A1 shall furnish his Property particulars and Bank account particulars after enlargement of bail within 15 days before the II Addl. Judl. Magistrate of I Class, Ongole, to enable trial Court in the event of considering the need of awarding compensation under Section 357 of Cr.P.C.

CPK,J CrlP_14484_2016 v) The petitioners/A1 and A2 shall surrender their passports, if any, into the II Addl.Judl. Magistrate of I Class Court and shall not leave the country without the permission of the Court."

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

Having regard to the circumstances of the case, by taking into consideration the nature of offence with which he is charged, and as the petitioner is a practising Advocate, the condition imposed by the Court below in directing the petitioner to appear before the Station House Officer concerned thrice in a week appears to be onerous. Therefore, the petitioner shall appear before the Station House Officer concerned once in a week i.e., on every Sunday, between 10:00 A.M., and 5:00 P.M., for a period of four (04) weeks or till filing of charge sheet, whichever is earlier. Insofar as furnishing details of the property and bank account particulars for the purpose of awarding compensation is concerned, the same shall be kept in a sealed cover by the Court. All other conditions shall remain unaltered.

With the above observation, the Criminal Petition is disposed of.
