Heard Mr.G.Venkateswarlu for petitioner and the Assistant Public Prosecutor for respondent No.1.

The petitioner though prays for quashing the proceedings in C.C.No.11 of 2016, on the file of the V-Additional Judicial Magistrate of the First Class, Nellore, but confines his prayer to recall the non-bailable warrant issued by the learned Magistrate on 10.07.2015.

Perused the material and I am prima facie satisfied that the alternate prayer of petitioner to recall the non-bailable warrant issued on 10.07.2015 can be considered, subject to the petitioner appearing before the learned V-Additional Judicial Magistrate of the First Class, Nellore on 05.10.2017.

The criminal petition is, accordingly, disposed of by recalling the non-bailable warrant issued against the petitioner on 10.07.2015, subject to the petitioner appearing before the learned V-Additional Judicial Magistrate of the First Class, Nellore on 05.10.2017 and continuing to appear as and when required.
