THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.P.No.5425 of 2016

ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A4 seeking to quash the proceedings in C.C.No.590 of 2015 on the file of Prohibition and Excise Magistrate, Guntur, for the offences punishable under Sections 498-A, 506 IPC and under Sections 3 and 4 of Dowry Prohibition Act, against her.

2. It is alleged in the charge sheet that A1, at the instigation of A2 to A4, subjected his wife i.e., de facto complainant, to cruelty and harassed her mentally and physically for additional dowry and necked her out from the matrimonial house. Based on the complaint, a case in Cr.No.72 of 2015 u/s. 498-A, 506 IPC and under Sections 3 and 4 of Dowry Prohibition Act, was registered against A1 to A4.

3. Heard and perused the material on record.

4. In view of the serious allegations mentioned in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. However, the petitioner/A4 being a lady, her presence before the trial Court is dispensed with except on the dates whenever her presence is insisted by the trial Court and she shall be represented by her counsel.

5. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
