THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11382 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/accused seeking grant of anticipatory bail in crime No.440 of 2015 on the file of the p.s., Madhapur, Cyberabad, Hyderabad, registered for the offence under Section 420 IPC. Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner's name was not found in F.I.R., and that the respondent/police are calling the petitioner herein to come to the police station.

Considering the facts and circumstances of the case, the respondent/police is directed to follow the procedure laid down in Section 41-A of Code of Criminal Procedure (CrPC) prior to arrest of the petitioner herein.
