HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.6825 of 2015 ORDER:
Heard the learned counsel appearing for the petitioner, the learned Government Pleader for Civil Supplies for the State of A.P. and Sri G. Sekhar Reddy, learned counsel for the Caveator.
2. This writ petition is filed seeking Writ of Mandamus declaring the proceedings dated 09.03.2015 passed by the 2nd respondent where under suspended the authorization of the petitioner's Fair Price Shop dealership for Shop No.9 Aguduru Village, Thonduru Mandal, YSR Kadapa District, without conducting an independent enquiry, as illegal and arbitrary.
3. On 09.03.2015, the authorisation of the petitioner was suspended by the 2nd respondent-Revenue Divisional Officer, Jammalamadugu, YSR Kadapa District, on the allegation, namely, that at the time of inspection of the 4th respondent, certain variations in the stocks have been noticed and also that 6-A proceedings were pending against the petitioner before the Joint Collector. Learned counsel appearing for the petitioner submits that pendency of 6-A proceedings is not a ground for cancellation of the authorisation. On the other hand, learned Government Pleader for Civil supplies submits that there is huge variation in the stock and that the suspension order is passed pending regular enquiry, which shall not be interfered with in the present writ petition.
4. Having regard to the submissions made by either side, the 2nd respondent-Revenue Divisional Officer, Jammalamaduguru, YSR Kadapa District, is directed to conduct regular enquiry against the petitioner and pass final orders, within a period of eight weeks from the
date of receipt of a copy of this order.
5. The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
