HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 17575 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus directing the respondents to allot work on surface of the Mine to the petitioner considering his pitiable condition and to pay the salary for the leave period.

Heard Smt. S. Hemalatha, learned counsel for the petitioner, and Sri J. Srinivasa Rao, learned standing counsel for the respondents. 3.

It has been contended by the petitioner that he was initially appointed as Badili Coal Filler in the respondent company on 17.12.1985 and later, promoted as Ground Trammer. While discharging his duties on 26.05.1997, he met with an accident and sustained a fracture to his left leg and he underwent a major operation and a steel rod was implanted in his left leg. As per the advice of the doctors to work him on surface, he made a representation to the respondents seeking to allot work on surface, but the same is pending. Aggrieved thereby, he filed the present writ petition. 4.

The main grievance of the petitioner is that though he made a representation to the respondents seeking to allot work on surface due to his health condition, the same is pending consideration. If the representation of the petitioner is not yet considered for allotment of work on surface, the respondents shall consider his case

sympathetically and allot surface work by duly taking into consideration his health condition.

With the above observation, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 29th August, 2018 cbs
