THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.15976 OF 2017 ORDER:

Petitioner is suspended by the order impugned in the Writ Petition on the ground of his involvement in a criminal case. This Writ Petition is filed challenging the prolonged suspension. 2.

Learned counsel for the petitioner contends that though other employees were also involved in the same criminal case, they were reinstated by revoking the suspension, whereas the petitioner is continued under suspension.

After investigation, police have filed charge sheet and the petitioner is one of the accused in the criminal case pending before the competent authority. Thus, at this stage, it cannot be said that continuation of suspension is bad in law. Therefore, no relief can be granted to the petitioner.

Having regard to the prolonged suspension and the relief granted to other co-accused, the Writ Petition is disposed of giving liberty to the petitioner to request the Commissioner of Police, Hyderabad City, Hyderabad, to review further continuation of suspension or prefer appeal before the Government against further continuation of suspension. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
