HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.27079 of 2015 ORDER:
Heard Sri P.Govinda Rajulu, learned counsel appearing for the petitioner and Sri B. Mayur Reddy, learned standing counsel for respondents-Corporation.
2. The petitioner was appointed as driver in the 2nd respondentRegion on 01.07.1993. While he was working as driver at Warangal-2 Depot, by order dated 05.09.2010, the Depot Manager imposed punishment of deferment of annual increment on the petitioner for a period of two years. Thereafter, by order dated 05.10.2010, the same Depot Manager, imposed punishment of deferment of annual increment for a period of one year. Again by order dated 31.12.2011, the same Depot Manager, imposed punishment of deferment of annual increment for a period of two years. All the above three punishments were imposed against the petitioner without cumulative effect.
The grievance of the petitioner is that even after completion of punishment period, though the punishments were minor in nature, in spite of his repeated requests, the said increments have not been restored by the respondents. It is further submitted by the petitioner that as per Circular No.P2/55(04)/2010-PO-IV dated 12.01.2011 of the Corporation, the petitioner is entitled for advance increment for completion of 20 years of service in the same cadre by counting his service from the date of his initial appointment. The said increment was also not granted to the petitioner. The version of the petitioner is he is entitled for advance increment with effect from August, 2013. He further submitted that he was declared unfit to the post of driver as per Medical Certificate dated 07.02.2014.
However, as he was declared fit for other than the driver post, the Corporation by order dated 20.02.
Depot without any break in service. The petitioner therefore filed the present writ petition seeking a direction to the respondents for restoration of the above mentioned increments and also for sanction of advance increment to him.
3. Learned standing counsel for the Corporation would submit that after verifying the service record of the petitioner and Service Regulations, appropriate action will be taken on the representation dated 15.12.2014 of the petitioner.
4. Under these circumstances, the writ petition is disposed of, directing the respondents to consider the representation dated 15.12.2014 submitted by the petitioner seeking restoration of the increments and also for sanction of advance increment as per Service Regulations and pass appropriate orders thereon, within a period of eight (8) weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, in this writ petition, shall stand closed. No order as to costs.
