THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16440 OF 2017 O R D E R :

The grievance of the petitioners is that respondents 2 and 3 are trying to demolish their properties situated on the main road, Kaligiri Village and Mandal, for the purpose of road widening, without following due process of law and without paying any compensation to them.

Learned Government Pleader for Roads and Buildings appearing for respondents 1 to 3 submits that the property in question does not belong to the petitioners and therefore, the petitioners have no right whatsoever on the same. Having considered the submissions made by the respective counsel and prima facie the material placed before this Court discloses that there is a semblance of right to the petitioners with respect to the property in question, the possession of the petitioners shall not be interfered with by the respondentauthorities without following due process of law as enjoined whether under the Land Acquisition, Rehabilitation and Resettlement Act, 2013 or in any other law.

Accordingly, the writ petition is disposed of directing the respondents not to interfere with the possession and enjoyment of the petitioners except following due process of law. No order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
