HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40375 of 2016 ORDER:

The present writ petition is filed seeking to declare the action of the respondents in not considering the representation, dated 26.10.2016, submitted by the petitioner, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioner is that her son by name, Bukka Shivakumar, was convicted for life, by the Family Judge-cum-IX Additional District and Sessions Judge, East Godavari District, Rjamahendravaram, in SC No.229 of 2011, for the offences under Sections 148, 302, 201, 365, 120(b), 379 and 109 r/ w.149 IPC. Presently her son is lodged in Central Prison, Rajahmundry. The petitioner is a resident of Siddipet, Siddipet District.

Her grievance is that she is suffering with kidney problem and also breast cancer, therefore she is unable to travel long distance to see her son and she made a representation, dated 26.10.2016, to the 2nd respondent requesting to shift her son from Rajahmundry Central Prison to Hyderabad Central Prison, and that the said representation is pending with the 2nd respondent, and therefore, she requested to direct the 2nd respondent to consider her representation. Considering the circumstances of the case and also the grievance of the petitioner, the 2nd respondent is directed to consider the representation, dated 26.10.2016, submitted by the petitioner, and pass appropriate orders in accordance with law, within a period of one month from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
