HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 4424 of 2015 Order:

This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the proceedings in DVC No.1 of 2015 on the file of the Judicial Magistrate of First Class, Bodhan, Nizamabad District. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor representing the State.

A perusal of the record would show that there is material, prima facie, sufficient to enquire into the allegations made against the petitioners herein in the complaint. There are no valid grounds to quash the proceedings. In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the Criminal Petition is disposed of directing the Judicial Magistrate of First Class, Bodhan, Nizamabad District to proceed with the case in DVC No.1 of 2015 without insisting for the presence of the petitioners 2 to 9 herein unless their presence is necessary.

As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed.
