Sri J.Rama Mohan Rao, learned counsel for the petitioner seeks permission to withdraw the petition. Permission is accorded.

2) Therefore, this petition is dismissed as withdrawn with a liberty to file an application for discharge, if no grounds to frame charge under Section 239 Cr.P.C, if charges not framed under Section 240 Cr.P.C and needless to say if charges framed, if there are any further grounds for discharge not urged earlier to file an application under Section 216 Cr.P.C to consider on own merits vide State of Orissa V. Debendranath Padhi[1].

3) Miscellaneous petitions, if any pending, shall stand closed.
