HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1322 OF 2017 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.) requesting to quash the First Information Report in Crime No.27 of 2017 of Miryalguda Rural Police Station, Nalgonda District.

Learned counsel for the petitioners-accused Nos.1 to 12, though, initially argued for quashing of the proceedings in Crime No.27 of 2017, restricts his submission to the extent of observing due formalities by the Investigating Officer as enlightened by the provisions of Section 41-A of the Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar v. State of Bihar1.

Accordingly, the criminal petition is dismissed. However, the Investigating Officer would adhere to the procedure prescribed under Section 41-A of the Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar's case (supra).

Miscellaneous applications, if any pending in this criminal petition, stand closed.
