THE HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.26108 of 2017 ORDER:

This writ petition is filed challenging the auction notice issued by the Deputy Registrar of Co-operative Societies Kadapa, Kadapa District, dated 21-7-2017 proposing to conduct auction of the property of an extent of Ac.0.02 1⁄2 cents of land along with residential house situated in S.No.441/2 having flat No.22 in Saipeta, Kadapa District pursuant the surcharge orders dated 3-4-1999. The petitioner claims that the said property is her absolute property and she got it from her son by way of registered settlement deed in 2006. Thereafter, she constructed a house by spending her retirement benefits. It is her further case that she retired from service as a teacher in the year 2004 and her husband has nothing to do with the said house property. She further submits that her husband filed W.P.No.

23070 of 2017 and this court was pleased to grant stay by order dated 18-7-2017. Since there is a provision for taking appropriate steps in case of claim of the writ petitioner, this court is not inclined to entertain the present petition but gives liberty to the petitioner to take appropriate proceedings in accordance with law with regard to her claim of the property. Accordingly, this Writ Petition is dismissed at the admission stage giving such liberty. No costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
