O R D E R
Aggrieved by the notice dated 02.07.2019 vide Ref. No.52Q/23368-0604 towards 'Notice for Setting a Sale Proclamation' with regard to the petitioner's property bearing H.No.1-10-38/2/67, 404, Lotus Flora Apartments, Prakashnagar, Begumpet, Hyderabad, Telangana, the present writ petition is filed.
Learned counsel for the petitioner submits that without proceeding against the principal employer, straightaway, the respondents cannot proceed against the personal property of the petitioner.
Sri Pasham Srinivasulu, learned Standing Counsel for respondents submit that auction could not take place as the tenants have not vacated, as such the cause in the writ petition does not survive.
Since the auction could not be conducted as scheduled, nothing survives in the writ petition for adjudication. As and when the respondents take further action, it is open to the petitioner to challenge the same in accordance with law. With the above observation, writ petition is disposed of. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
