THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.34431 OF 2015 ORDER:
Heard the learned counsel for the petitioner, learned Government Pleader appearing for the respondents 1 to 4 and the learned counsel appearing for the 5th respondent. The prayer sought for in the writ petition is as under: "to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of respondents 3 and 4 in repeatedly insisting the petitioner to appear before their authority and compelling to vacate from his landed property admeasuring Ac. 1-05 cents covered by Survey No. 626/1, situated in Tsundur Village and Mandal of Guntur District as illegal, irregular, irrational, without jurisdiction and violative of articles 14 and 21 of the Constitution of India and consequently direct the respondents 3 and 4 not to interfere in any manner with his liberty and possession over my said landed property."
The basic grievance of the petitioner is that the respondents 3 and 4 are repeatedly insisting the petitioner's presence before them and in the process, compelling him to vacate the land admeasuring Ac.1-05 cents in Sy.No.626/1, situated in Tsundur Village of Guntur District.
The learned Government Pleader for Home appearing on behalf of respondents 1 to 4 placed on record the written instructions dated 04.11.2015 issued by the Station House Officer, Tsundur Police Station, Guntur District. The same is made part of the record. From the perusal of the said written instructions, it is revealed that the petitioner and the 5th respondent have disputes in respect of the land in question. The 5th respondent lodged a
complaint with the 4th respondent against the petitioner alleging that the petitioner beat her with legs and hands in connection with the land dispute and also threatened her with dire consequences. Basing on the said complaint, a case in Crime No.90 of 2015 was registered for the offences under Sections 323, 324 and 506 I.P.C. and investigation was taken up. However, the petitioner has been absconding and filed the present writ petition with false allegations only to avoid arrest. The respondents-police have specifically stated that they never interfered in the civil disputes between the petitioner and the 5th respondent.
Having regard to the above, this Court is of the opinion that no further orders are required in the writ petition and the same is accordingly closed. No costs.
