HON'BLE SRI JUSTICE R.KANTHA RAO Writ Petition No.29622 of 2015 ORDER:
Heard Sri Lukalapu Ranjith Kumar, learned counsel appearing for the petitioner, learned Government Pleader for Panchayat Raj, Sri MSR Chandra Murthy, learned special counsel for the 2nd respondent and Sri Cheemalapati Ravi, learned standing counsel for the 3rd respondent.
2. The petitioner was appointed as Field Assistant of Sasamam Village, Tekkali Mandal of Srikakulam District on 01.03.2010. By order dated 10.08.2015 of the 2nd respondent, she was kept under suspension on the ground that she was not discharging the duties properly.
3. Learned counsel appearing for the petitioner submits that without issuing any show cause notice, the petitioner was suspended and the order impugned is illegal. Learned Special counsel for the 2nd respondent submits that the order impugned is only an order suspending the petitioner pending enquiry and therefore, the same needs no interference in the present writ petition.
4. Considering the submissions made on either side, I am not inclined to examine the merits of the case, since the order was passed in contemplation of an enquiry. Under these circumstances, the 2nd respondent-Project Director is directed to complete the enquiry against the petitioner after affording opportunity of hearing to the petitioner and pass appropriate orders in accordance with law, within a period of eight (8) weeks, failing which the order of suspension shall stand revoked.
5. The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No
costs.
