Rafath Sultana v. M/S Shriram Chit Fund Pvt.Ltd.,
THE HON'BLE SRI JUSTICE DILIP B.BHOSALE CIVIL REVISION PETITION No. 269 of 2015 P.C.:
This C.R.P. is against the order, dated 26.12.2014, passed on the petitioner's application under Order 20 Rule 11 (2) of the Code of Civil Procedure seeking permission to pay the decretal amount by monthly instalments at Rs.3,000/- . The prayer of the petitioner has been rejected by the impugned order. Learned counsel for the parties, however, agreed for the following order: "The petitioner undertakes to deposit Rs.15,000/- (Rupees fifteen thousand only) per month till the entire decretal amount is paid to respondent No.1decree holder. The petitioner shall pay the monthly instalment on or before 10th of every month. The first instalment to be paid by her would start from May, 2015. In case of any two defaults, it would be open to respondent No.1-decree holder to execute the decree."
With these observations, the C.R.P. is disposed of. Consequently, miscellaneous petitions, if any, also stand disposed of. _____________________ DILIP B.BHOSALE,J Dt:17.04.2015 kdl
