THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6146 OF 2017 ORDER:

This writ petition is filed challenging the action of the third respondent in interfering in the civil disputes seeking to enforce the terms of the lease deed, dated 09.03.2016 and summoning the petitioner repeatedly to the police station in the guise of investigation in crime No.45 of 2017. The third respondent filed counter affidavit stating that the petitioner is first accused in crime No.45 of 2017 and the matter is under investigation. The petitioner was issued notice under Section 41-A of Code of Criminal Procedure (CrPC) and when he was asked to present before the third respondent, the petitioner filed the present writ petition instead of complying with the notice. It is also stated that the third respondent is not interfering in the civil disputes as alleged by the petitioner.

In the circumstances, liberty is given to the third respondent to continue the investigation in accordance with law without unnecessarily harassing the petitioner. In view of the denial of the allegation of interference in civil disputes, no further relief can be granted to the petitioner. The writ petition is accordingly closed.
