HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN Civil Revision Petition No.4970 of 2016 Order:
This revision arises out of the concurrent orders of the Courts below granting an interim order of injunction pending suit for bare injunction.
2. Heard Sri Y.Ramatirtha, learned counsel for the petitioner.
3. The main thrust of the argument of the learned counsel for the petitioner is that on the basis of certain documents not related to the suit schedule property, both the Courts below have granted an injunction in respect of a property which has been in possession and enjoyment of the petitioner herein. According to the learned counsel, the respondents are attempting to interfere with her possession, after obtaining the orders of injunction.
4. But unfortunately, in a matter of this nature when two Courts have concurrently granted an interim order of injunction and the same is in force at least for the past two years, it is not now feasible to interfere with the same. Therefore, the revision is dismissed. The Trial Court shall dispose of the suit within a period of two months. The miscellaneous petitions, if any, pending in this revision shall stand closed. No costs.
