HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.1 3 2 8 8 of 2 0 1 8 ORDER: - Heard learned Counsel appearing for the petitioners and the learned Government Pleader for respondents. The grievance of the petitioners in the present writ petition, as advocated by the learned Counsel appearing for the petitioners, is that despite the Orders of this Court, dated 20.06.2017, in W.P.No.18171 of 2017, the 2nd respondent/ the Chairman, District Level Compensation Committee and District Collector is not holding enquiry nor passed any Orders. Earlier, when the District Level Compensation Committee passed an Order on 01.05.2017 awarding compensation of Rs.36,05,490/ -, the 4th respondent herein filed W.P.No.18171 of 2017 before this Court and this Court on 20.06.

2017 disposed of the said Writ Petition and the operative portion of the said Order reads as under: - "In the light of the aforesaid admissions of the learned Government Pleader and as we are satisfied that failure, on the part of the district level committee, to furnish a copy of the inspection report and to provide the petitioners an opportunity of hearing, is in violation of principles of natural justice, the impugned order is set aside. Needless to state that this order shall not preclude the district level committee from complying with principles of natural justice and, thereafter, passing an order afresh in accordance with law.

As the impugned order itself is being set aside on the ground of violation of principles of natural justice, it is unnecessary to examine the other contentions urged by the learned Senior Counsel for the petitioners."

The grievance of the petitioners, in the above background is that though a considerable length of time has lapsed from the date of passing of the said Order, the 2nd respondent is not taking the matter and in view of the same, the petitioners herein are suffering irreparable loss and hardship.

Having heard the learned Counsel appearing for the petitioners and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition, directing the 2nd respondent to take up the issue and enquire into the matter and pass final orders pursuant to the Orders of this in W.P.No.18171 of 2017, dated 20.06.2017, strictly in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs. ______________ A.V.Sesh a Sai, J Date: 17.04.2018 smr
