This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ A.1, for grant of anticipatory bail in Crime No.388 of 2019 of Dundigal Police Station, Cyberabad, registered for the offences punishable under Sections 498-A, 324 and 506 of IPC and Sections 3 and 4 of Dowry Prohibition Act. 2.

Heard learned counsel for the petitioner/ A.1, learned Additional Public Prosecutor representing the respondent/ State and perused the record.

The case of prosecution, in brief, is that the marriage of the petitioner and the de facto complainant was solemnised on 28.02.2019. After their marriage, they lived happily for four days. Thereafter, the petitioner and his mother harassed the de facto complainant mentally and physically for additional dowry. They also threatened her that second marriage will be performed if she fails to bring additional dowry. Thereafter, she was driven out of the house on 10.05.2019. Hence, the aforesaid case was registered against the petitioner. 4.

Learned counsel for the petitioner/ A.1 would submit that the petitioner never harassed the de facto complainant at any point of time; that she herself left the company of the petitioner without informing him; that she used to harass the petitioner and his old aged mother; that on seeing her attitude, the petitioner has filed divorce petition and that on receiving the said notice, the de facto complainant has filed the present false case against the petitioner. The petitioner is innocent and

he is the only earning member of his family. Hence, he prayed to grant anticipatory bail to the petitioner.

Learned Additional Public Prosecutor representing the respondent-State opposed to grant bail to the petitioner/ A.1. 6.

Having regard to the nature of allegations levelled against the petitioner/ A.1, this Court is not inclined to grant bail to the petitioner/ A.1.
