HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Civil Revision Petition No.3128 of 2017 ORDER:

Aggrieved by the order dated 06.01.2017 in E.P.No.20 of 2012 in L.A.O.P.No.851 of 1999 passed by the Judge, Family Court-cum-VI Additional District Judge, Kadapa closing the E.P, the Dhr. filed the instant CRP.

2) The submission of learned counsel for petitioner as well as learned Government Pleader for Arbitration (AP), is that unfortunately the Execution Court has not correctly shown the E.P amount and the deposits made by the J.Dr and thereby calculation errors were occurred and therefore, the impugned order may be set aside. 3) In view of the above submission, this Civil Revision Petition is allowed by setting aside the impugned order dated 06.01.2017 in E.P.No.20 of 2012 with a direction to the Execution Court to receive the fresh calculation memos submitted by both parties and pass an order afresh on merits.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
