RESPONDENTS Petition under Arlicle 226 of the Constitution of lndia praying that in' the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or order more particularly one in the nature of writ of mandamus declaring the action of the respondents in not considedng the case of the petitioners for promotion to the post of Assistant Divisional Engineer as illegal, arbitrary, unconstitutional and consequently direct the 2nd respondent to promote the petitioners to the post of Assistant Divisional Engineer by holding the Degree obtained by the petitioners from IASE Rajasthan as valid from the date of passing with all consequential benefits l.A. Today when the matter has been taken up fcr hearing learned counsel for the petitioner on instructions seeks permission of this Court to withdraw the writ petition with a liberty to the petitioner to file fresh petition.

Recording the submissions made by the learned counsel for the petitioner, permission is accorded to writ petitioner to withdraw the writ petition.

Accordingly, the writ petition is dismissed as withdrawn. With a liberty to the petitioner to file fresh petition in accordance with law. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
