THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10362 of 2017 ORDER:

This Writ Petition is filed challenging registration of Crime No.19 of 2017 pursuant to reference of the complaint of the third respondent by the concerned Magistrate. Since the case is referred by the concerned Magistrate after applying his mind and the same is registered as FIR No.19 of 2017, it is for the second respondent to investigate the crime. Learned Counsel for the petitioners submits that the petitioners have nothing to do with the crime and the said issue is a matter for investigation.

In the circumstances, this Court is not inclined to entertain the present Writ Petition, but directs the second respondent to follow due process of law, not to unnecessarily harass the petitioners and comply with Section 41-A of the Code of Criminal Procedure during the course of investigation. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
