HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.19880 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer on permanent basis. The authorization of the petitioner is valid till 31.03.2016. The third respondent issued show cause notice dated 27.05.2015 based on the report of the Tahsildar, Adoni. The petitioner submitted his explanation on 22.06.2015. The petitioner's grievance is that, in spite of submitting explanation, respondent Nos.3 and 4 are not releasing stock. Hence the Writ Petition. It is needless to mention that, so long as the authorization of the petitioner is in force, the petitioner is entitled for release of stock.

This Court noticed that the variation mentioned in the show cause notice is marginal and within the permissible limit. However, the petitioner had already submitted his explanation and an enquiry has to be conducted in respect of the allegations levelled against him. The third respondent shall complete the enquiry, and pass final orders, within a period of sixty days from the date of receipt of a copy of this order.
