O R D E R

This arbitration application is filed under Section 11(4) and (6) of the Arbitration and Conciliation Act, 1996 (for short 'the Act of 1996'), read with the Scheme for Appointment of Arbitrators, 1996, to appointment an arbitral tribunal comprising one or three arbitrator/arbitrators to adjudicate the claims and disputes between the applicants and the respondents. Learned counsel appearing for both the parties, on instructions, submit that they have no objection for appointment of an arbitrator, who held a judicial office.

There is no dispute with regard to existence of arbitration cause in the agreement dated 01.07.2018 entered into between the parties, and also with regard to issuance of notices.

In view of the same, Sri Justice K.C.Bhanu, retired judge of High Court of erstwhile State of Andhra Pradesh, is appointed as arbitrator, to adjudicate the claims and disputes between the parties and to pass an award in accordance with law.

The learned Arbitrator shall be entitled to fees as per the rates specified in the Fourth Schedule to the Act of 1996, inserted by Act 3 of 2016 with effect from 23-10-2015, which shall be borne by both parties in equal proportion. The arbitration application is accordingly allowed. Interlocutory applications pending, if any, shall stand closed.
